During cross-examination, Subramanian deposed that before he was produced in the Kancheepuram Court on December 27, 2004, he was in illegal custody for around 15 days and was harassed by then Superintendent of Police Premkumar and Additional Superintendent of Police Sakthivel.SP Premkumar had been dismissed in May 2007. Maintaining that the harassment caused physical and mental agony, he said his wife and children were also in police custody and harassed.
Since his wife and children were in the police custody, he, out of fear, gave a statement dictated by the police before the court, Subramanian said, adding that he was now stating the truth because the officers who arrested him were not in service.

Premkumar had already been suspended for allegedly bribing and coercing Ravi Subramanian, accused-turned-approver in the murder case, to escape from prison.Its the same Ravi Subramanian, who turned hostile in court today.
Premkumar, who then held the post of sub-inspector at the police station, arrested Nallakaman and his son and physically attacked them. He tied their bodies with a chain and dragged them on the streets to disgrace them. Moreover, he filed false cases against Nallakaman and his son.Nallakaman was aged 74. Premkumar was awarded 6 months of imprisonment.

Interesting news report. Other than the witnesses, a few more persons need to turn hostile, chief among them being Chindu's own Chief, who took an extraordinary in the issue to the extent of travelling along with the Junior Acharya (from Andhra Pradesh border to Chennai) apparently to convince Vijayendra Saraswathy to revolt against Jayendra Saraswathi. In this matter, he played the role of drum beater for the former CM, writing several sensational articles and editorials against Jayendra Saraswathi. Otherwise, Chief's hostility to the former CM is only too well known!

Simple imprisonment sentence against police officer quashed

New Delhi: The Supreme Court on Tuesday quashed a Madurai Bench of the Madras High Court judgment awarding one-month simple imprisonment to a senior police officer, Prem Kumar, in a case relating to handcuffing and parading of an ex-serviceman.
A Bench of Justice Markandey Katju and Justice T.S. Thakur allowed appeals filed by Mr. Prem Kumar challenging the judgment.
It was Mr. Prem Kumar's argument that the High Court did not consider that the trial court had convicted him in one case and acquitted him for the very same charge in another case; both the cases were based on the facts of the same incident and witnesses and evidence.
He said the allegation that Nallakaman (first respondent) was paraded and handcuffed through the street with leading chain had not been proved.
The High Court did not consider that all the independent witnesses had stated that the first respondent had attacked him and deterred him from discharging official duties inside the police station.
During the resumed hearing on Tuesday, senior counsel Sushil Kumar, appearing for Mr. Prem Kumar, submitted that the incident happened in 1982 and whatever the appellant did was within his official duties.
He had not exceeded his powers.
Though senior counsel Colin Gonsalves, appearing for Mr. Nallakaman tried to justify the High Court order, the Bench accepted the contentions of Mr. Prem Kumar, allowed his appeals and quashed the impugned judgment.
Prem kumar has been asked to submit the judgement copies to the government to be re instated on services "bad news for acharya"
